Approach Part 237 as a classification and citation problem. For any scenario, first decide which defined term in § 237.5 applies and which subpart (A through G) governs the activity, then state the specific section requirement. Practice that two-step decision before reviewing engineering content, because scope and responsibility questions decide what everything else in the rule applies to.
Deciding Whether a Structure Is a Railroad Bridge Under § 237.5
The definition has two independent branches: any structure with a deck supporting one or more railroad tracks, regardless of length, or any undergrade structure with an individual span of 10 feet or more affected by live loads. Classify before you plan any inspection.
The two branches fail in different directions. A timber trestle deck only two panels long still counts because the deck branch has no length threshold. A concrete pipe under the embankment counts only if an individual span reaches 10 feet and live loads affect it. A common error is applying the 10-foot threshold to every structure, which wrongly excludes short deck bridges and wrongly includes small pipes. Memorize each branch's trigger separately instead of blending them into one mental rule.
Scope consequences follow immediately. Only structures meeting § 237.5 enter the accurate bridge inventory required by § 237.33(a), get a recorded safe load capacity under § 237.33(b), and fall inside the inspection program in § 237.33(d). Section 237.1 also narrows the part's reach: it applies to track of two feet gage or more supported by a bridge, with exceptions for disconnected urban rapid transit and installations outside the general railroad system. So scope is a two-gate test: does Part 237 apply to the track, and is the structure a railroad bridge.
- Deck branch: any decked structure supporting one or more railroad tracks, regardless of length.
- Undergrade branch: individual span of 10 feet or more, at a depth where live loads affect it.
- Track gate: gage of two feet or more, supported by a bridge, minus the § 237.1 exceptions.
Assigning Responsibility When Track Is Leased or Contractors Work
The track owner holds compliance responsibility under § 237.3, but responsibility can be assigned by written notification to FRA's Track and Structures Division at least 30 days before the assignment, and contractors performing any Part 237 function must comply with the part themselves.
The assignment procedure is unusually specific. The written notification must include the track owner's and assignee's names, addresses, and email addresses; a statement of their exact relationship; precise identification of the track segment and individual bridges; a statement of the assignee's competence and ability to carry out bridge safety duties; and a signed acknowledgment from the assignee. FRA may reject the assignment for cause and may hold the owner, the assignee, or both responsible. An assignment already made under 49 CFR 213.5(c) needs no duplicate notification.
Subpart C layers role designations on top of entity responsibility. A railroad bridge engineer, per § 237.51, must be competent to determine forces and stresses, prescribe safe loading conditions, prescribe inspection and maintenance procedures, and design repairs and modifications. Sections 237.53 and 237.55 cover railroad bridge inspectors and supervisors, and § 237.57 addresses designations of individuals. Read those sections in the current rule text rather than relying on summaries. Also note § 237.7: each day a violation continues is a separate offense, penalties against individuals require willfulness, and knowingly falsifying a required record carries criminal exposure under 49 U.S.C. 21311.
Telling Bridge Repair From Bridge Modification Before Work Starts
A bridge repair remediates damage or deterioration that has affected structural integrity; a bridge modification changes configuration in a way that affects load capacity. The label controls whether Subpart F's design and supervision duties attach and how the work is documented.
The definitions point in opposite directions. Repair looks backward at existing deterioration; modification looks at a change to configuration with a capacity effect. Replacing corroded members in kind restores the bridge and sits on the repair side. Installing heavier members specifically so the span can carry a new loading class changes what the bridge can carry, which is the modification definition even though the physical work looks similar. Classify the intent and the capacity consequence first, then choose the procedure.
The classification drives Subpart F. Section 237.131 governs design of repairs and modifications, and § 237.133 governs their supervision, which connects back to the qualified railroad bridge engineer functions in § 237.51, including designing repairs and modifications. The distinction also feeds the documentation duty in § 237.33(c), which requires documenting all repairs, modifications, and inspections. A work package filed under the wrong label leaves the audit trail in Subpart G incomplete even if the physical work was sound.
Worked Scenario: Classifying Two Undergrade Structures on One Subdivision
A 12-foot span culvert under the track embankment meets the undergrade branch of the railroad bridge definition; a 6-foot pipe beside it does not. The correct decision changes what enters the inventory and inspection program.
The plausible mistake: a trainee building an inventory lists both structures as bridges, reasoning that anything under the track is a bridge. That inflates program scope and forces capacity records for a structure the rule does not cover. The better decision: apply § 237.5 branch by branch. The culvert has an individual span of 12 feet, which is 10 feet or more, and its depth puts it within live load effects, so it is a railroad bridge. The 6-foot pipe fails the span threshold and supports no deck, so it is not.
Why it matters: every downstream obligation keys off this classification. The culvert needs a unique identifier, location, configuration, construction type, and span data in the § 237.33(a) inventory, plus a recorded safe load capacity and coverage in the § 237.33(d) inspection program. Now reverse the test on a 9-foot decked structure carrying track: it counts, because the deck branch has no length threshold. If your drill answers flip correctly between these cases, you understand that the branches are independent, not one blended rule.
Worked Scenario: A Floor Beam Replacement That Raises Capacity
Replacing deteriorated floor beams with heavier sections specifically to permit a heavier loading is a bridge modification, not a repair. Treating it as repair skips the Subpart F design duties and breaks the documentation chain.
The plausible mistake: the crew calls the job a repair because old members were deteriorated, files it under repair forms, and moves traffic over the upgraded span. The better decision: ask what changed. If the new sections were chosen so the bridge can carry a load it could not safely carry before, the configuration change affects load capacity, which is the § 237.5 definition of modification. Subpart F then applies: design under § 237.131 and supervision under § 237.133, performed consistently with the engineer functions listed in § 237.51.
Why it matters: Subpart D connects here. Section 237.71 addresses determination of bridge load capacities and § 237.73 addresses protection of bridges from over-weight and over-dimension loads, so a capacity change must be reflected in the safe load capacity record required by § 237.33(b). A mislabeled job leaves the capacity record stale and the audit trail under § 237.155 inconsistent with what actually happened to the structure. The lesson is procedural: the label is not paperwork, it is the switch that routes the work through the rule.
Building a Bridge Management Program That Matches § 237.33
A compliant bridge management program needs an accurate bridge inventory, a record of each bridge's safe load capacity, design documents where available plus repair and inspection documentation, and an inspection program with six specified minimum elements.
Read § 237.33 as four blocks. Blocks one and two are data: the inventory with a unique identifier, location, configuration, construction type, number of spans, span lengths, and other information needed to manage bridge safety, and the safe load capacity record. Block three is documentation: obtain and maintain design documents when available, and document all repairs, modifications, and inspections. Block four, the inspection program under § 237.33(d), is the piece candidates most often skim, yet it lists six required minimums that are directly checkable in a question.
The six inspection-program elements are: personnel safety considerations; types of inspection including required detail; definitions of defect levels with associated condition codes if codes are used; the method of documenting inspections including standard forms or formats; structure type and component nomenclature; and the numbering or identification protocol for substructure units, spans, and components. Section 237.31 sets when each category of track owner had to adopt such a program, phased across carrier classes and passenger operations. Section 237.9 allows petitioning for a waiver under part 211, but filing a petition does not suspend the compliance duty while it is considered.

A useful habit is to name the section that answers each audit question: who scheduled it, what procedure applied, where the record lives, and who reviewed the report.
